The Website is a free referral service to assist homeowners in connecting with local service contractors. Contractors are independent and are not employees, agents, partners, joint venturers, or representatives of Neighborly. We do not perform, supervise, or control the work of any contractor and do not set a contractor’s availability, methods, qualifications, price, schedule, or result.
You are responsible for evaluating a contractor, confirming the scope and terms of work, asking for references or documentation you consider appropriate, and deciding whether to enter a separate agreement. It is your responsibility to verify that the hired contractor furnishes the necessary license and insurance required for the work being performed.
Permitted Use License
Subject to these Terms, Neighborly grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Website for your personal, lawful, non-commercial information and referral needs. This license does not transfer ownership of any content, software, design, trademark, or other intellectual-property right.
You may not copy, republish, sell, rent, lease, sublicense, frame, mirror, distribute, modify, reverse engineer, decompile, create derivative works from, scrape, data-mine, or use the Website or its content to build a competing service without our prior written permission. To the fullest extent permitted by law, the total liability of Neighborly for claims arising from the Website or these Terms will not exceed the greater of the amount you paid Neighborly for the specific Website use giving rise to the claim or $100. Release and Indemnification

Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to the Website or these Terms will be resolved by final, binding arbitration on an individual basis under the Federal Arbitration Act and the applicable consumer arbitration rules of a nationally recognized arbitration provider. The arbitrator, rather than a court, will decide the enforceability and scope of this arbitration provision. The hearing may be held remotely or in the county where you live, unless the parties agree otherwise.
You and Neighborly waive the right to a jury trial and agree that arbitration may not proceed as a class, collective, consolidated, or representative action. The arbitrator may award the same individual relief available in court, subject to these Terms and applicable law. Nothing prevents either party from bringing an individual qualifying claim in small-claims court or seeking temporary or injunctive relief for unauthorized access, misuse, or intellectual-property infringement.
Arbitration Opt-Out
You may opt out of the arbitration and class-action-waiver provisions by sending a written opt-out notice to Neighborly Pest Control Service, Bloomington, Indiana, Attention: Arbitration Opt-Out, or by emailing privacy@neighborlypestcontrolservice.us within 30 days after first accepting these Terms.
